Key Event Insurance Definitions you need to know

When filling out our instant quote form, or when reading your policy documents, some words and phrases may appear unusual. We’ve worked with Beazley to create a quick guide laying out each of these words, their meanings, and how they could apply to policyholders.

Definitions of Event Insurance Key Terms

Accident/Accidental

Sudden and unforeseen circumstance resulting in bodily injury and/or property damage.

Bodily Injury

Bodily injury includes death, physical injury, illness or disease.

Communicable Disease

An illness caused by a pathogen and transmitted from an infected person or animal to another person or animal.

Damages

Financial amounts for which you become legally responsible to pay as a direct result of bodily injury or property damage.

Dangerous Activities

These are activities organised by you or on your behalf or for which you are responsible.

What are classed as dangerous activities?
Dangerous activities at events include (but are not limited to):

  • Fireworks, bonfires or pyrotechnical devices
  • Inflatable play equipment 
  • Fairground rides or mechanically propelled rides of any kind
  • Ballooning
  • Quad bikes, go-karts or motor sport of any kind
  • Trampolines or gymnastic apparatus of any kind
  • Circus acts or stunt acts
  • Shooting ranges for guns or archery

At Insure Our Event, we do not provide insurance for bouncy castles, inflatable play equipment, slides or rides (mechanical or otherwise) which are set up, operated and taken down by a bona fide sub-contractor. This contractor should in fact provide you with evidence of their current public liability insurance. These are not classed as dangerous activities.

Employee

As understood within event insurance, an employee is a formal or casual contract to work for you in connection with the event.

  • Temporary employees (paid or unpaid)
  • Labour only sub-contractors 
  • Person hired to or borrowed by you
  • Self-employed persons 
  • Work experience trainees
  • Authorised volunteers
  • And those deemed by the court to be an employee of the Insured

Excess

The first amount of any claim or claims as detailed in your schedule for which you are responsible.

Limit

The amount shown to be insured in the schedule.

Nuclear Risks

Actual or threatened, ionising radiations or contamination by radioactivity from any nuclear fuel or any nuclear waste from the combustion of nuclear fuel or the radioactive, toxic explosive or other hazardous properties of any explosive nuclear device or assembly or component of such device.

Occurrence

Accident or series of accidents originating from one cause.

Period

The date from which this policy commences (as shown in the schedule) and the date where all cover under this policy ends (also as shown in the schedule).

Pollution

Pollution or contamination by naturally occurring or man-made substances, forces, organisms or any combination of these.

Property Damage

Physical loss of or destruction to property which is hired, leased or borrowed by you. Schedule The attachment to this policy which sets out your details and the details of the event and the coverage provided.

Terrorism

United Kingdom An unlawful act, including but not limited to the use of force or violence, of any person or groups of persons, whether acting alone or on behalf of or in connection with any organisations or governments, committed for political, religious, ideological or similar purposes including the intention to influence any government and/or to put the public, or any section of the public, in fear. England, Scotland, Wales, Northern Ireland, the Channel Islands and the Isle of Man.

Venue

The places, buildings or other structures stated in the schedule where the event is to be held.


What are the General Conditions within event insurance policies?

In combination with Beazley... Here are the general conditions of an event isnurance policy:

False or Fraudulent acts

Any fraud, concealment, or intentional misstatement of the information provided or in the making of a claim, shall entitle us to refuse payment of a claim or treat this policy as though it had never existed.

Reasonable care

You will need to take reasonable care to:

  • Prevent accidents,
  • Maintain all premises plant and equipment and everything used in connection with the event in proper repair,
  • Employ only competent employees,
  • Act in accordance with all statutory obligations and regulations,
  • Act on any defect or damage as soon as they become apparent, to either remedy or repair any such defect or danger or take such additional precautions as the circumstances require to avoid such defect or danger.

Third party insurance

You must require any independent stall holder, exhibitor, contractor or supplier whom you engage at or for the event to hold third party liability insurance in their own right for the duration of the event.

Your right of recovery

You must not waive or in any way impair your right of recovery from any other party in connection with any claim or part of a claim, and you must make available to us if required a copy of any contract or agreement into which you enter with any party, in connection with the event.

Other Insurance

If there is any other insurance in force covering claims arising out of the event then we will only pay the amount in excess of the sum due from such other insurance as if this policy were not in force.

Rights of Recovery

With respect to bodily injury to an employee, while this policy will provide cover to pay damages in accordance with the provisions of any law, (other than compensation under any Workers Compensation or similar legislation), relating to compulsory insurance of liability to employees, it is understood and agreed that you shall repay to us all sums which we would not have been responsible to pay but for the provisions of such law ordinance or statute.

Discharge of Liability

We may at any time agree to pay you in connection with any claim or series of claims covered under this policy to which a limit applies the amount of such limit (after deduction of any sums already paid) or any lesser amount for which such claims can be settled.  When payment has been made, we shall relinquish the conduct of and be under no further obligation with such claims.

Assignment

This policy may not be assigned in whole or in part without our prior written consent. 

Contract (Rights of Third Parties) Act 1999

No person(s), company or other party who is not named as insured in the schedule shall have any rights under the Contract (Rights of Third Parties) Act 1999 to enforce any terms or conditions of this policy.  This shall not affect any right or remedy of a third party that exists or is available apart from the Act

Severability, construction and conformance to statute

If any provision in this policy is for any reason held to be illegal or unenforceable in any respect, it is deemed to be deleted and have no effect. If any provision contained within this policy is for any reason held to be illegal or unenforceable, it will be construed by limiting it so as to be valid, legal and enforceable to the extent compatible with the applicable law. Any provisions of this policy which are in conflict with the statutes or regulations of the state wherein this policy is issued are hereby amended to conform to such statutes or regulations.
